Plaintiff asserts that he has filed this Cross-Motion late because he has yet to receive a copy of Defendant's 29 Reply to his 27 Opposition to the Motion for Summary Judgment. That justification, however, is without merit, because Plaintiff's deadline to file his Cross-Motion for Summary Judgment predated Defendant's deadline to file any Reply.
