2023-08-0212MINUTE entry before the Honorable Harry D. Leinenweber: Plaintiff Hannibal Bey's application to proceed in forma pauperis 4 is denied and the case is dismissed without prejudice. Upon review of an application in forma pauperis, the Court must dismiss an action that fails to state a claim on which relief may be granted. 28 U.S.C. § 1915(e)(2)(B)(ii). Here, Plaintiff has not provided a legible set of facts upon which relief can be granted. Plaintiff's motion for attorney representation 5 is dismissed because Plaintiff has failed to complete the portion of her motion regarding whether she has sought legal representation and if not, why she has been unable to. Plaintiff may motion the Court to reopen the case and her in forma pauperis application once the defects in her Complaint have been corrected. Plaintiff's Motion to Enter Notice of Attorney Not Allowed to Testify 9 is denied for failure to provide basis for motion or purpose of attorney testimony. Plaintiff's Freedom of Information Act (FOIA) request 10 was improperly filed before this Court. A FOIA request must be submitted to a governmental agency or body, and this Court's jurisdiction over a FOIA suit arises under 5 U.S.C. § 552(a)(4)(B) only after requester has exhausted her administrative remedies. 2023-12-2813ANNUAL REMINDER: Pursuant to Local Rule 3.2 (Notification of Affiliates) , any nongovernmental party, other than an individual or sole proprietorship, must file a statement identifying all its affiliates known to the party after diligent review or, if the party has identified no affiliates, then a statement reflecting that fact must be filed. An affiliate is defined as follows: any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party. The statement is to be electronically filed as a PDF in conjunction with entering the affiliates in CM/ECF as prompted. As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported.
