Plaintiff seeks leave to amend his complaint to add allegations concerning a subsequent FOIA request that he filed on May 2, 2024 at the government's suggestion, see Dkt. 12 at 1-2. Although the amended pleading may more appropriately be considered a supplemental pleading because it concerns a "transaction, occurrence, or event that happened after the date of the pleading to be supplemented," Fed. R. Civ. P. 15(d), "[m]otions to amend under Rule 15(a) and motions to supplement under Rule 15(d) are subject to the same standard," Wildearth Guardians v. Kempthorne , 592 F. Supp. 2d 18, 23 (D.D.C. 2008). Under that standard, leave to amend (or to file a supplemental pleading) "should be freely given in the absence of undue delay, bad faith, undue prejudice to the opposing party, repeated failure to cure deficiencies, or futility." Richardson v. United States , 193 F.3d 545, 548-49 (D.C. Cir. 1999) (citing Foman v. Davis , 371 U.S. 178, 182 (1962)). Here, there is no evidence that Plaintiff is seeking to amend his complaint in bad faith. Nor is it likely that the amendment will cause undue delay. The case is in its early stages and the parties have yet to file any dispositive motions. In fact, permitting amendment of the current complaint may even streamline any such motions practice. Defendant states that it is ready to move for summary judgment on the issue of whether the original FOIA request was too vague to warrant a search, see Dkt. 14 at 3-4. The May 2, 2024 FOIA request was submitted in an effort to remedy the vagueness of the original FOIA request, so the addition of that request to this case may eliminate the vagueness issue (at least in part). Defendant also faces no undue prejudice from the amendment, see Kight v. Crunchy Tobacco, Inc. , No. 21-cv-3189, 2022 WL 20651175, at *4 (D.D.C. Oct. 7, 2022) ("Where the proponent of the amendment establishes that the additional claim would not (1) unduly increase discovery; (2) delay the trial; or (3) surprise the opponent, then the amendment should be allowed."), and Defendant may even face less of a burden than if Plaintiff were to bring a new action concerning the May 2 FOIA request. Finally, although Defendant argues that amendment would be futile because the May 2, 2024 FOIA request is itself too ambiguous to warrant a search, that issue is best resolved in a briefing on the merits. The Court recognizes that efforts to supplement pending FOIA cases with new FOIA requests submitted after the litigation commenced, and perhaps in response to the ongoing litigation, may often undermine the expeditious and efficient resolution of FOIA cases. This, however, is not such a case, and, for reasons explained above, granting Plaintiff leave to amend (or to supplement) may streamline this case. For these reasons, Plaintiff's motion for leave to amend is GRANTED. Plaintiff is further ORDERED to file his amended complaint on or before July 29, 2024. Signed by Judge Randolph D.
