| 2025-04-14 | 21 | ** TEXT ONLY ORDER ** Plaintiff William Jewell, a federal prisoner who represents himself, has filed a motion for appointment of counsel in this civil action. (Dkt. # 18 .) There is no right to appointment of counsel in civil cases. A court may, in its discretion, recruit a lawyer who is willing to volunteer to represent an indigent civil litigant, but it need only do so where the legal and factual difficulties of the case exceed the litigant's ability to represent himself. Pruitt v. Mote, 503 F.3d 647, 654-55 (7th Cir. 2007). Before making that determination, the court must first find that the litigant has made reasonable efforts to recruit an attorney on his own and has been unsuccessful. Jackson v. County of McLean, 953 F.2d 1070, 1072 (7th Cir. 1992). This court generally requires litigants in plaintiff's position to submit letters from at least three attorneys declining to represent them, or, if they received no response letters, a declaration attesting to whom they reached out for representation and when they sent the letter. Plaintiff has not met this threshold requirement. Therefore, plaintiff's motion for appointment of counsel (dkt. # 18 ) is DENIED. Signed by District Judge William M. Conley on 4/14/2025. (voc),(ps) (Entered: 04/14/2025) |
| 2025-04-29 | 22 | ** TEXT ONLY ORDER ** The court held a telephonic preliminary pretrial conference on April 29, 2025, to set the case schedule and discuss discovery and other aspects of case management. Plaintiff William Andrew Jewell appeared, representing himself. Defendants were represented by AUSA Robert Joynt. After confirming the trial date, plaintiff stated his disinterest in continuing the scheduling process and asked to hang up. Although the court invited plaintiff to remain on the call, explained that the conference was an opportunity for him to ask questions, and indicated that it would continue the scheduling process without him, plaintiff hung up. The court completed the scheduling process with defense counsel and will issue the schedule in a separate order. Defense counsel noted that defendants are contemplating whether to request a stay of discovery in this matter and may file a motion. Signed by Magistrate Judge Anita Marie Boor on 4/29/2025. | 2025-10-24 | 28 | ** TEXT ONLY ORDER ** The government has requested to stay some civil cases to which it is a party, including this one, citing a lapse in funding that has impeded its ability to litigate the cases. Courts have broad discretion to stay cases to manage their dockets and promote efficiency. Landis v. N. Am. Co. , 299 U.S. 248, 254 (1936). In deciding whether to impose a stay, the court must balance those interests favoring a stay against those interests frustrated by the action. Feed.Ing BV v. Principle Sols. , LLC, No. 14-cv-1241, 2015 WL 13158324, at *1 (E.D. Wis. Apr. 21, 2015). Here, the court is charged with seeing this case to a just and speedy resolution. See Fed. R. Civ. P. 1. A just resolution requires that both sides have an opportunity to fully participate in and litigate the case, so a stay under the current circumstances is warranted. But a stay also means some delay. At this point, it is not clear how long the lapse in funding will last. All things considered, the balance of the interests weighs in favor of granting the stay, but that may change as time goes on, and the opposing party may seek to lift the stay should the balance of interests change. For now, the stay will remain in place until the lapsed funding is restored. Within seven days of the restoration of funding, the parties must submit a joint proposed order to reset the schedule, calculating the new case deadlines by adding the elapsed time to the original schedule. The court will review the proposed order and either enter it or set the case for a telephonic status conference. Signed by Magistrate Judge Anita Marie Boor on 10/24/2025.
