2012-03-0916STIPULATION AND ORDER OF SETTLEMENT AND DISMISSAL: IT IS HEREBY STIPULATED AND AGREED, by and between the parties, as follows:1. Pursuant to Rule 41(a)(l)(A)(ii) of the Federal Rules of Civil Procedure, the ACLU agrees to dismiss this action with prejudice. 2. Defendant shall pay to the ACLU the sum of $7,500.00 in attorneys' fees and litigation costs, pursuant to 5 U.S.C. § 552(a)(4)(E), which sum the ACLU agrees to accept as full payment of any attorneys' fees and costs it has incurred in this action. Upon payment,the ACLU releases the United States, its agencies, departments, officers, employees,servants, and agents, including the Department of Health and Human Services ("HHS")and the IHS, from any claims for attorney's fees, costs and expenses of any kind, and however denominated, relating to services performed in connection with this matter.
