Case DescriptionThe Electronic Privacy Information Center submitted a FOIA request to the National Security Agency for records concerning a presidential order authorizing the NSA to conduct surveillance without a warrant. EPIC also requested expedited processing. The agency responded to the request by disclosing two pages. The agency indicated it was withholding other records under Exemption 1 (national security), Exemption 3 (other statutes), and Exemption 5 (privileges). EPIC filed an administrative appeal, but after hearing nothing further from the agency, EPIC filed suit.
