Presently pending before the Court is Defendants' motion to extend the deadline for filing a dispositive motion to August 4, 2008 54 . Plaintiffs oppose the motion because the original deadline of June 9, 2008, was established by stipulation among the parties after considerable delay. The Court ordinarily relies on counsel to comply with their stipulations regarding deadlines and to work out any needed extensions through the cooperative process that is essential to proper functioning of the judicial system. Regrettably, the parties have been unable to fulfill the Court's expectation. The Defendants did indeed have some unexpected issues, though they can be faulted for not reporting those issues promptly to Plaintiffs and not taking steps to ameliorate the impact of those issues. For their part, Plaintiffs are properly anxious to move forward with an already delayed case and are chagrined at Defendants' failure to abide by the parties' stipulation. Giving a little to each party, the Court fixes July 21, 2008 as the date on which Defendants must file their dispositive motion. DEFENDANTS ARE ADVISED THAT THERE WILL BE NO FURTHER EXTENSION OF THAT DATE. If it makes Defendants', or this Court's, task any easier if Defendants provide Plaintiffs with a copy (or even draft) of the needed declarations in advance of July 23, 2008, the Court urges Defendants to do so, but the filing date set forth in this Order is not contingent on the parties agreement regarding the form or content of Defendants' declarations.
