Case DescriptionCitizens for Responsibility and Ethics in Washington submitted a FOIA request to the Department of Homeland Security for records concerning the Secretary's method of communicating with the White House. CREW also requested a fee waiver. The agency denied CREW's request for a fee waiver and told CREW that it would need to commit to paying fees. CREW filed an administrative appeal of the agency's denial of its fee waiver request. Without referring to CREW's appeal, the agency once again told CREW that it would need to commit to paying fees. Having heard nothing further from the agency concerning its administrative appeal, CREW filed suit.
