2008-09-158STIPULATION AND ORDER; Plaintiffs agree to withdraw numbered paragraphs 2, 4, 6(a), (b), (c), (d), (e), (g), and 7, of section B of the FOIA Request. Plaintiffs agree that they will not challenge the exemptions claimed for records produced by ICE in its First FOIA Response in response to paragraphs 2, 4, and 7 of section B of the FOIA Request. Plaintiffs agree to withdraw paragraph 5 of section B of the FOIA Request in exchange for ICE's provision of nationality information from the pages of the First FOIA Response Bates stamped 183-187, and ICE's representation that the National Fugitive Operations Programs Weekly Statistical Reports related to the operations described in paragraph 2 of section B of the FOIA Request ("the Operations") do not contain information or data pertaining to legal justification for entry. Plaintiffs agree to limit their request in paragraph 6(f) of section B of the FOIA Request to responsive documents dated January 1, 2006, to April 18, 2008, the date Plaintiffs' FOIA Request was received by ICE. Plaintiffs agree not to challenge exemptions ICE has claimed for records produced in ICE's First FOIA Response in response to paragraphs 6(a)-(e) of section B of the FOIA Request. In exchange, ICE avers that it made a total of 419 arrests during the Operationsand ICE agrees to the terms further set forth in this Stipulation and Order. Any request in Plaintiffs' FOIA Request for documents "to the present" refers to April18, 2008, the date the FOIA Request was received by ICE. ICE agrees to produce documents responsive to the FOIA request and this Stipulation and Order and provide Plaintiffs with a draft Vaughn Index by December 2,2008. ICE will provide Plaintiffs with a final Vaughn Index by 1/9/2009. Any motion for summary judgment by either side must be filed by 1/9/2009. Opposition to any such motion must be filed by 1/23/2009 and any reply must be filed by 1/30/2009. Oral argument on any such motion will take place on 2/6/2009 at 5:00 p.m. SO ORDERED.
