FOIA Project Annotation: A federal court in Washington, after reviewing a sampling of 127 documents in a case involving more than 18,000 pages of responsive materials concerning the FBI's Violent Gang and Terrorist Organization File, has ruled that the agency failed to justify a number of exemption claims, particularly under Exemption 1 (national security) and Exemption 7 (law enforcement records). Judge Robert Lasnik initially observed that "courts are not well-suited to run executive branch functions, including law enforcement activities and the terrorist watch list. Courts are, however, capable of determining whether a party is in compliance with the law, and that is the issue presented here." Starting with Exemption 1, Lasnik explained that the FBI had withheld six documents in the sample because disclosure would reveal intelligence activities or intelligence gathering activities. The agency had withheld large portions of an email transmitting an undisclosed attached document. Lasnik observed that "most of the redactions seem to be employee names, the withholding of which plaintiff does not contest. It is hard to imagine what intelligence activities or limitations are hidden in other redacted sections." The agency's affidavit described the contents as containing information about intelligence activities or intelligence-gathering activities. Lasnik noted that "such weighty matters seem well beyond the scope of this one-page procedural email. The 'Summary and Justification' offered for [the email] simply repeats, in truncated fashion, the substance of the [agency's] declaration." Lasnik added that "absent some effort to tailor the explanation to the specific document withheld, neither plaintiff nor the Court is able to evaluate the merits of the redaction. The FBI has, in effect, parroted the language of the Executive Order (in the disjunctive) and declared that the redacted information falls within one or more of the categories covered by the order. This categorical approach is 'clearly inadequate.'" The major dispute between the parties concerning redactions of identifying information under Exemption 7(C) (invasion of privacy concerning law enforcement records) was the scope of the redactions. Lasnik indicated that "descriptors that apply to whole populations, such as race, sex, country of birth, and passport country, are not reasonably likely to identify any particular individual. Other information, such as criminal history, telephone number, and license plate number, could be combined with publicly available information to identify an individual and may therefore be redacted under Exemption 7(C)." Lasnik objected to many of the agency's redactions under Exemption 7(E) (investigative methods and techniques) dealing with procedures under the VGTOF program that had already been made public. The agency had said that "complete revelation" of VGTOF standard operating procedures would increase risk of circumvention. In response, he noted that "the logical inference arising from the nature of SOPs and [the agency's] careful choice of language is that entire sections of the document can be likely disclosed without any real risk to the watchlisting process." Lasnik also indicated that the agency had been too stingy in reviewing information about "silent hits," information which was already public. He observed that "it is not enough to disclose the term 'silent hits' where it was previously redacted. Plaintiff has shown that certain operational details of the procedure, the protocol for selecting a subject, the four sub-groups indicating level of interest, and the corresponding warning statements for law enforcement officers have all been publicly disclosed. Defendant apparently recognizes that plaintiff is entitled to all iterations and versions of publicly-available material and yet continues to withhold the same information in documents. No explanation or justification is given." Lasnik also found that because the plaintiffs qualified for news media status, the agency could not charge any fees for search or duplication because they had failed to respond within the statutory time limit.

FOIA Project Annotation: A federal court in Washington has rejected most of the government's supplemental arguments for several documents the court had previously ordered disclosed to the ACLU of Washington pertaining to the Violent Gang and Terrorist Organization File guidelines. The government claimed Exemption 7(E) (investigative methods and techniques) for several documents. The court noted one document dealt with communications with other agencies once a suspect on the VGTOF list was identified. Calling the agency's harm claims "wholly conclusory," the court pointed out that the agency had provided no "information describing how coordination among federal agencies gives rise to a reasonable expectation that identifying the agencies that follow up on a positive VGTOF response will thwart law enforcement." For another document, the government claimed that disclosing the minimum level of interest for inclusion in the VGTOF would risk circumvention of law. The court indicated that "this argument verges on the illogical. A positive VGTOF response is not disclosed to the individual. Thus, a person who already suspects or affirmatively believes that he is on the VGTOF watchlist has all the incentive he needs�"or is likely to get�"to conceal illegal activities, destroy evidence and/or modify his behavior."
