2015-06-19MINUTE ORDER granting 13 Judicial Watch's motion for relief from judgment. In view of revelations that then-Secretary of State Clinton and members of her staff used personal email accounts to conduct State Department business, and that emails from those accounts may not have been covered by State Department searches for documents responsive to the FOIA request at issue in this case, the plaintiff seeks to reopen this case for further proceedings. The State Department agrees that the case should be reopened under these circumstances. Judicial Watch relies upon Federal Rule of Civil Procedure 60(b)(3), which permits relief in cases of "fraud (whether previously called intrinsic or extrinsic), misrepresentation, or misconduct by an opposing party." To obtain relief under Rule 60(b)(3), "the burden of proof of fraud is on the moving party and... fraud must be established by clear and convincing evidence." 11 Charles Alan Wright & Arthur R. Miller, Federal Practice and Procedure § 2860 (3d ed. 2014); see also Sack v. CIA, 53 F. Supp. 3d 154, 178 (D.D.C. 2014). The State Department suggests Rule 60(b)(2), which allows for reopening due to "newly discovered evidence that, with reasonable diligence, could not have been discovered in time to move for a new trial under Rule 59(b)." Judicial Watch indicates that it did not rely upon Rule 60(b)(2) solely because of a statement in a footnote of this Court's Opinion in Sack, which stated that Rule 60(b)(2) "address[es] defects in or changed circumstances regarding a prior Court judgment." Sack, 53 F. Supp. 3d at 179 (D.D.C. 2014). This statement in no way affects this case: The newly discovered information is a changed circumstance regarding the prior judgment in this case--i.e. the stipulated dismissal in 2014. Because the parties agree that Rule 60(b)(2) applies, the Court will rely upon that provision, rather than spilling ink to resolve their dispute as to whether Judicial Watch has submitted clear and convincing evidence of fraud by the State Department. For that reason, the Court GRANTS Judicial Watch's motion and ORDERS that this case be REOPENED and restored to the active calendar of this Court. To the extent that the parties' pleadings regarding the reopening of this case under Rule 60(b) address issues regarding the State Department's FOIA obligations once this case is reopened, the Court finds that such arguments are not proper subjects of a Rule 60 motion. They may be raised in an appropriate motion at such time as they become relevant. The parties are directed to submit a joint status report, setting forth their individual recommendations for further proceedings in this newly reopened case, by no later than July 1, 2015. "The power to stay proceedings is... inherent in every court to control the disposition of the causes on its docket with economy of time and effort for itself, for counsel, and for litigants." Fonville v. Dist. of Columbia, 766 F. Supp. 2d 171, 172-73 (D.D.C. 2011) (quoting Air Line Pilots Ass'n v. Miller, 523 U.S. 866, 879 n. 6 (1998)). Significant progress has been made in this case since it was reopened in June 2015. Neither judicial economy nor the interests of justice will be served by staying this matter at this time. In light of this Order, the Wednesday, September 16, 2015 hearing at 10 a.m. is CANCELLED. However, the Government is ordered to include in its September 21, 2015 status report, information about the volume of documents it has received from Ms. Mills and Ms. Abedin. Upon consideration of the parties' and non-party Bryan Pagliano's pleadings addressing the legal authority upon which Mr. Pagliano relies to assert his Fifth Amendment rights in this civil proceeding with respect to any deposition questions regarding "the creation and operation of clintonemail.com for State Department business", see ECF No. 73, the Court HEREBY ORDERS: (1) Mr. Pagliano's 85 Motion for a Protective Order is DENIED. Consistent with the Court's May 26, 2016 Minute Order and the treatment of all other deponents, Mr. Pagliano's deposition shall be videotaped and the audiovisual of his deposition shall be sealed until further order of the Court; (2) Mr. Pagliano's 88 Motion for Leave to File Under Seal is GRANTED; Mr. Pagliano's immunity agreement with the Department of Justice shall be sealed consistent with U.S. v. Hubbard in which the D.C. Circuit identified six factors to consider when determining whether the strong presumption in favor of public access to judicial proceedings may be overcome. 650 F.2d 293 at 31722 (D.C. Cir. 1980). Those factors include: (1) the need for public access to the documents at issue; (2) the extent of previous public access to the documents; (3) the fact that someone has objected to disclosure, and the identity of that person; (4) the strength of any property and privacy interests asserted; (5) the possibility of prejudice to those opposing disclosure; and (6) the purposes for which the documents were introduced during the judicial proceedings. Id; see also E.E.O.C. v. Nat'l Children's Ctr., Inc., 98 F.3d 1406, 1409 (D.C. Cir. 1996). In the Court's opinion, the need for public access to Mr. Pagliano's agreement with the government is minimal. Mr. Pagliano's immunity agreement has not previously been disclosed. Mr. Pagliano and the government object to disclosure of the immunity agreement. Indeed, the privacy interests at stake are high because the government's criminal investigation through which Mr. Pagliano received limited immunity is ongoing and confidential. Mr. Pagliano's immunity agreement with the government was filed with the Court by Mr. Pagliano solely to enable the Court to assess the legitimacy of his intent to assert his Fifth Amendment rights in this civil proceeding. 2018-09-26MINUTE ORDER. The Court is encountering technical difficulties with Ms. Mills' audiovisual deposition. Specifically, the video stops playing at 14:02. The parties are therefore directed to deliver a corrected copy of Ms. Mills' audiovisual deposition by no later than October 3, 2018. The Court further directs the Department of State, Ms. Mills, and any other deponent arguing that the audiovisual recording of their deposition should remain under seal, to file supplemental pleadings pointing to specific parts of the depositions that would "annoy[], embarras[],oppress[], or undul[y] burden" the deponent if released. See Fed. R. Civ. P. 26(c). Such supplemental pleading shall be filed by no later than October 17, 2018 and shall include references to relevant timestamps. The Department of State should also clarify whether it opposes unsealing all audiovisual deposition testimony or specific audiovisual depositions. Accordingly, the Court hereby reschedules the motion hearing previously scheduled for October 11, 2018. The motion hearing shall now take place at 2:00 pm on November 14, 2018 in Courtroom 24A. For the reasons discussed at the November 14, 2018 motions hearing, the Court grants in part and denies in part 111 News Media Coalition's motion to intervene to seek reconsideration. The Court grants News Media Coalition's motion to intervene but denies its motion for reconsideration of the Court's Order sealing the audiovisual deposition testimony. The Court also denies 153 Judicial Watch's motion to unseal the audiovisual recordings of all depositions. The Court finds that good cause remains to keep the audiovisual recordings under seal. Therefore, all audiovisual copies of depositions taken in this case shall remain under seal. The Court also denies 140 Judicial Watch's motion to compel Mr. Bentel's testimony and sustains Mr. Bentel's invocation of his 5th Amendment privilege. Finally, the Court grants in part and denies in part 141 Judicial Watch's motion to compel Former Secretary Clinton's answers to interrogatories. Secretary Clinton is therefore compelled to answer questions 1 and 24, as modified by the Court. Her objection is sustained as to question 14. Secretary Clinton shall provide her answers to modified questions 1 and 24 by no later than December 17, 2018. The parties are further ordered to file a joint status report updating the Court as to the status of the litigation and recommending next steps for further proceedings by no later than December 5, 2018.
