Case DescriptionCREW submitted a FOIA request to the Justice Department for records of communications between DOJ and the Georgia Government Transparency and Campaign Finance Commission pertaining to potential violations of the Ethics in Government Act or the Georgia Government Transparency and Campaign Finance Act by Georgia Gov. Nathan Deal. CREW also asked for a fee waiver. In response, DOJ's Criminal Division sent CREW a generic form letter saying that to confirm or deny the existence of records without consent or an overriding public interest would cause an unwarranted invasion of privacy under Exemption 6 (invasion of privacy) and Exemption 7(C) (invasion of privacy concerning law enforcement records). CREW appealed the response from the Criminal Division to the Office of Information Policy, but after hearing nothing further, CREW filed suit.
