2016-06-01MINUTE ORDER:The parties appeared before this Court on June 1, 2016, for a status conference in this FOIA case. During that conference, USAID represented that it has identified approximately 3,300 pages of records that are potentially responsive to Plaintiff's FOIA requests. In accordance with the discussion held on the record during this conference, it is hereby ORDERED that USAID shall process all of the records that it has deemed responsive to Plaintiff's FOIA requests on or before July 11, 2016, and that, on or before that same date, USAID shall (1) produce to Plaintiff the subset of non-exempt responsive records that are not subject to interagency consultation or referral, and (2) transmit the remaining responsive records to the State Department for consultation or referral with respect to the requested production. It is FURTHER ORDERED that USAID shall file a status report on July 19, 2016, in which it will provide the Court with an update on the status of the transmitted documents and provide a complete schedule for the production of responsive records; specifically, the status report shall include both an estimate of the amount of time that it will take the State Department to perform its consultation or referral duties with respect to the transmitted documents and a proposed schedule for the production of the remaining responsive non-exempt records in light of the State Department's estimate. Based on USAID's representations at the conference, it is the Court's expectation that, once State completes its consultation and referral duties, any and all responsive, non-exempt documents that have been transmitted to State by USAID will be promptly released.
