Case DescriptionThe Council on American-Islamic Relations-Connecticut and Make the Road New York submitted FOIA requests to the Department of Homeland Security and U.S. Customs and Border Protection for records concerning policies regarding screening of individuals at ports of entry. The organizations also submitted a FOIA request to U.S. Citizenship and Immigration Services for records concerning the criteria used in considering visa applications. The organizations also submitted a FOIA request to the Department of State for records concerning criteria used in considering visa applications. The agencies acknowledged receipt of the requests, but after hearing nothing further from any of the agencies, the Council on American-Islamic Relations-Connecticut and Make the Road New York filed suit.

2023-03-24224ORDER: The defendants argue in their Memorandum in Support of their Motion for Summary Judgment, (Doc. No. [216-1]), that by opting initially to challenge only the withholding of the Executive Order ("EO") Report, the plaintiffs waived their right to challenge any of the withholdings asserted in three additional Department of State ("State") documents. ( See Doc. No. [216-1] at 12). In support of their position, the defendants rely upon a case involving markedly different facts. ( See id. , citing Am. Ctr. for L. & Just. v. DOJ , 325 F. Supp. 3d 162 (D.D.C. 2018)). In that case, the Court prohibited a party from expanding the scope of the issues it sought to raise on a motion for summary judgment after a briefing schedule was set and the party's opening brief was filed. See Am. Ctr. for L. & Just. , 325 F. Supp. 3d at 168-69 (emphasis added); see also Nat. Day Lab. Org. Network v. ICE , 811 F. Supp. 2d 713, 738 (S.D.N.Y. 2011) (holding that plaintiff waived FOIA challenges not raised in its brief). Here, however, the plaintiffs raised challenges to three additional State documents during a status conference on December 16, 2022, three days before the parties proposed a briefing schedule. ( See Doc. Nos. 210 , 211 ). The parties' Joint Status Report, which the undersigned adopted on December 22, 2022, explicitly stated that the "[p]laintiffs intend[ed] to cross-move for summary judgment to challenge Defendants' withholdings of four documents ." (Doc. No. 211 at 1) (emphasis added). Accordingly, the Court will consider the plaintiffs' challenge to the defendants' withholding of the EO Report and the three additional State documents. The defendants previously provided the EO Report to the Court for an in camera review; however, they did not provide a copy of the three State documents that they have withheld pursuant to FOIA exemptions. The defendants argue that State properly asserted FOIA Exemption 7(E) to withhold portions of a document entitled "ALDAC: Heightened Screening of Visa Applications Further Guidance; MRN: 17 STATE 52856" ("State Cable") and another entitled "Operational Q&As on 17 STATE 25814 and 17 STATE 52856" ("Operational Q&A"). ( See Doc. No. [216-1] at 33). Furthermore, the defendants maintain that State properly asserted the deliberative process and attorney-client privileges under FOIA Exemption 5 to withhold in full a third document entitled "Supporting Statement for Paperwork Reduction Act Submission," related to 82 Fed. Reg. 20,956 ("PRA Supporting Statement"). ( Id. ). The Court must examine the three State documents in camera to determine whether the defendants have a valid basis for withholding them, and whether and to what extent privilege may have been waived. See ACLU v. DOJ , 15 CV 1954(CM), 2016 WL 889739, at *5-6 (S.D.N.Y. Feb. 25, 2016) (requiring the government to produce documents withheld under a FOIA exemption for in camera review so that the Court could determine whether the exemption applied and to what extent, if any, privilege had been waived). The Court directs the defendants, by March 31, 2023 , to produce the State Cable, the Operational Q&A, and the PRA Supporting Statement in the same manner in which they submitted the EO Report, indicating each portion that has been withheld from each document and the FOIA exemption justifying each withholding. Plaintiffs shall file their opposition to defendants' motion for reconsideration on or before July 7, 2023 , and defendants shall file their reply papers on or before July 14, 2023 . The parties shall file another joint status report on or before June 30, 2023 , informing the Court as to their progress in resolving all outstanding issues in this case. The Court further directs that the parties' next joint status report may not simply advise that they are "continuing to engage in settlement negotiations" ( see Doc. Nos. 235 , 237 , 239 ), and shall instead include substantive updates as to the parties' efforts to resolve the outstanding issues. If the parties would prefer to discuss these updates in a conference with the Court, they may file an appropriate request on the docket.
