Case DescriptionBenjamin Wittes and Scott Anderson of Lawfare, and the Protect Democracy Project submitted two FOIA requests to the Department of Justice for records concerning communications between agency officials and President Trump or White House officials pertaining to Andrew McCabe. Wittes' second FOIA request asked for communications sent to or from former acting Attorney General Matthew Whittaker pertaining to McCabe. Wittes also requested expedited processing and a fee waiver. The agency acknowledged receipt of the requests but after hearing nothing further from the agency, Wittes filed suit.
