2022-03-0856STIPULATION AND ORDER: IT IS HEREBY STIPULATED AND AGREED, by and between Plaintiffs and Defendant, subject to endorsement by the Court, that: 1. The Potentially Spam Documents and the Other Documents shall constitute the documents responsive to Plaintiffs' FOIA request. 2. Defendant shall process the Other Documents at a rate of at least 500 pages per month, beginning on the date this Stipulation is endorsed by the Court, subject to the following conditions: a. Any blank pages shall not count toward Defendants monthly quota. b. If, after processing a record, Defendant determines that it must engage in consultation with or referral to another agency under 31 C.F.R. § 1.3(d) about that record, the pages subject to the consultation or referral shall count toward Defendants quota for the month in which it made that determination, and shall not count toward Defendant's quota for any other month. 3. Within one month from the date this Stipulation is endorsed by the Court, Defendant shall produce all non-exempt portions of one of the Potentially Spam Documents as a sample of those records. This sample shall count toward Defendant's production quota for the first month. Plaintiffs shall review the sample and decide whether to request that Defendants process additional Potentially Spam Documents. If Plaintiffs decide to request further processing of the Potentially Spam Documents, the parties shall negotiate in good faith regarding the scope of such processing and, if they reach agreement, shall propose any amendments to this Stipulation and Order that they deem appropriate. 4. Within 90 days from the Court's endorsement of this Stipulation and Order, the parties shall file a joint letter updating the Court on the status of the production, and shall file similar letters every 90 days thereafter until Defendant's production is complete. 5. Within 60 days from the date Defendant informs Plaintiffs that Defendants' production of all records is complete, Plaintiffs shall inform Defendant if they intend to challenge any aspect of Defendant's production. The parties shall then confer, and within 30 days file a joint letter proposing next steps for this action. 6. This Stipulation and Order contains the entire agreement between the parties, and no statement, representation, promise, or agreement, oral or otherwise, between the parties or their counsel that is not included herein shall have any force or effect. 7. 2023-12-2181STIPULATION AND ORDER OF SETTLEMENT AND DISMISSAL IT IS HEREBY STIPULATED AND AGREED, by and between the parties, as follows: 1. The documents produced by Defendant and its payment of attorney's fees and litigation costs fully settle any and all claims Plaintiffs now have or may hereafter acquire against Defendant or the United States of America (the "United States"), or any department, agency, officer, or employee of the United States, arising out of Plaintiffs' FOIA request at issue in this action, except as described in paragraph 2. 2. As soon as practicable after the Court has approved and docketed this Stipulation and Order, and following Plaintiffs provision of payment-related information to Defendant, Defendant shall pay to The New York Times Company (or to another person or entity at Plaintiffs' request) the sum of $8,462.00 in attorneys fees and litigation costs, pursuant to 5 U.S.C. § 552(a)(4)(E), which Plaintiffs agree to accept as full payment and satisfaction of any attorney's fees and costs Plaintiffs have incurred or will incur in this action for services performed up to the date of this Stipulation and Order. Any subsequent claim for attorney's fees and costs in connection with this matter will be limited to a claim for fees and/or costs in connection with any future application to enforce the Stipulation and Order.
