Case DescriptionThe James Madison Project and reporter Josh Gerstein submitted FOIA requests to the CIA, the other agencies that are part of the intelligence community for records concerning requests for unmasking the identities of U.S. citizens referenced in foreign intelligence reports. JMP and Gerstein also requested expedited processing. The agencies acknowledged receipt of the requests but after hearing nothing further from any of the agencies, JMP and Gerstein filed suit.

2023-09-12MINUTE ORDER granting 39 Motion for Summary Judgment: Defendants have moved for summary judgment on the grounds that they have properly withheld documents under FOIA exceptions 1, 3, 6, and 7(e). Plaintiff concedes the Motion. 40 . "[T]he Court may award summary judgment solely on the basis of information provided by the department or agency in declarations when the declarations describe 'the documents and the justifications for nondisclosure with reasonably specific detail, demonstrate that the information withheld logically falls within the claimed exemption, and are not controverted by either contrary evidence in the record nor by evidence of agency bad faith.'" Citizens for Responsibility & Ethics in Wash. ("CREW") v. Dept of Labor , 478 F. Supp. 2d 77, 80 (D.D.C. 2007) (quoting Military Audit Project v. Casey , 656 F.2d 724, 738 (D.C. Cir. 1981)). Based on the information provided in the Motion and the attached Declarations, the Court finds that the documents at issue have been properly withheld and thus grants Defendants' Motion for Summary Judgment.
