Case DescriptionThe ACLU of Maine submitted a FOIA request to U.S. Citizenship and Immigration Service for records concerning the denial of asylum applications by the Newark Asylum Office and the Boston sub-office. The ACLU of Maine also requested expedited processing and a fee waiver. The agency acknowledged receipt of the request. The agency granted the ACLU of Maine's request for a fee waiver but denied its request for expedited processing. The ACLU of Maine filed an administrative appeal of the denial of expedited processing. After hearing nothing further from the agency, the ACLU of Maine filed suit.

FOIA Project Annotation: A federal magistrate judge in Maine has ruled that U.S. Citizenship and Immigration Services has not yet justified its exemption claims made in response to FOIA requests from Dr. Basileus Zeno, a native of Syria who is now a college professor in the United States, for records about the denial of his request for asylum and data pertaining to rates of asylum grants at USCIS offices in Boston and Newark. A Significant Interest Group handled Zeno's request, which focused primarily on policies and procedures relating to affirmative asylum cases arising out of the Boston and Newark offices. The Significant Interest Group referred his request to the Refugee, Asylum, & International Operations Directorate, the Office of Performance and Quality, and the Office of Policy and Strategy for responsive records. Refugee, Asylum & International Operations had its employees search their emails, using a number of search terms, while the Office of Performance Quality searched the agency's Global database, which is the agency's management system for all Asylum Division case type data. When an asylum application is filed and as it continues through the process of interview and consideration, staff input into Global certain data relating to the application. The Office of Policy and Strategy determined it did not have responsive records. The agency's searches yielded 6,121 pages and two spreadsheets of data. 3,840 of the pages were released entirely, 2,273 pages contained partial redactions, and eight pages were withheld entirely. Zeno, who was represented by the ACLU of Maine, argued that USCIS had failed to produce a document entitled "Employee Performance Plan and Appraisal Form," and requested certain budget documents from 2015 through 2021. The agency produced budget documents and two spreadsheets of data which contained more than 100,000 rows and columns containing identifying information about asylum applicants. Zeno narrowed the number of disputed records to 343 pages. The agency reviewed the remaining 343 pages and disclosed some previously redacted information. The agency also provided the Employee Performance Plan and Appraisal Form and an additional spreadsheet of data containing identifying information about asylum officers. If an asylum officer determines that an applicant is not eligible for asylum, the asylum officer refers the applicant's case to the administrative immigration court within the Executive Office for Immigration Review. Referral notices contain personal identifying information about asylum applicants. Referral notices are generated by asylum officers using the Global database. Referral notices do not create or modify agency policy or practice. Asylum officers may not rely on or cite referral notices as legally binding. Instead, asylum officers are instructed to rely on decisions by the Board of Immigration Appeals, the Attorney General, and federal courts. If an asylum officer finds an applicant ineligible for asylum, a notice of intent to deny is issued. Denial notices are generated through the Global database and contain personal information about asylum applicants. Denial notices do not create or modify USCIS's policy or practice. The remainder of the disputed information regarding individual applicants can only be obtained by searching individual A-Files, which contain the most complete and accurate accounting of an individual's immigration history and eligibility. The only way USCIS could search for records on A-Files processed by the Boston or Newark offices would be to run individuals processed by those offices by searching biographical information to locate the individual's A-File. USCIS estimated that to respond to Zeno's request would require 78,000 person-hours to search and an additional 156,000 person-hours to review. Even with Zeno's narrowed request, USCIS asserted it would take 7,250 person-hours to search and 14,500 person-hours to review. Zeno did not challenge the adequacy of the agency's search but contested its time estimate. Magistrate Judge John Nivison found that the agency's search was adequate and that its time estimates were proper. He also approved of the agency's Exemption 5 (privileges) claims, under the deliberative process privilege. He also approved redactions under Exemption 6 (invasion of privacy), noting that "the risk of a violation of an individual's privacy rights outweighs any probative value to the public's ability to assess Defendant's process." Nivison indicated that while many of the agency's claims under Exemption 7(E) (investigative methods or techniques) were appropriate, the public interest in disclosing information that reflected on government operations was strong. He decided to review several categories of Exemption 7(E) claims in camera, noting that "defendant may withhold materials used to investigate or collect information regarding immigration fraud, but it may not withhold materials it uses to define immigration fraud and what immigration fraud looks like in certain circumstances."
