Case DescriptionMartin Woodbury submitted a FOIA request to the Bureau of Alcohol, Tobacco and Firearms for records concerning its investigation of Tracy Worwood's possession of military explosives. The agency acknowledged receipt of the request. The agency denied the request. Woodbury filed an administrative appeal. The agency affirmed its original denial. Woodbury then submitted a FOIA request to the FBI for records on the investigation of Worwood. The agency acknowledged receipt of the request and referred Woodbury to the denial by BATF. Woodbury filed an administrative appeal with the FBI. The FBI acknowledged receipt of the appeal, but after hearing nothing further from the agency, Woodbury filed suit.

Upon consideration of the parties' 21 Joint Status Report, it is ORDERED that the following schedule will govern further proceedings: the defendant shall file a motion for summary judgment on or before April 9, 2024; the plaintiff shall file an opposition to the motion for summary judgment and any cross-motion on or before May 25, 2024; the defendant shall file a reply brief in support and opposition to any cross-motion on or before June 25, 2024; and the plaintiff shall file a reply brief in support of its cross-motion on or before July 31, 2024. The Court further notes that the motion for summary judgment and opposition must comply with LCvR 7(h), which requires that each party submitting a motion for summary judgment attach a statement of material facts for which that party contends there is no genuine dispute, with numbered paragraphs and specific citations to those portions of the record upon which the party relies in fashioning the statement. The party opposing the motion must include a statement that enumerates all material facts that the party contends are genuinely disputed. The opposing party's statement must (1) restate the movants statement of undisputed material fact in numbered paragraphs, and (2) immediately following each numbered paragraph state the opponents response to the stated fact.
