Kennelly: John Bridenhagen has file a pro se lawsuit challenging the Defense Intelligence Agency's response to his request under the Freedom of Information Act. Venue appears to be proper in this district because Mr. Bridenhagen lives here. See 5 USC 552(a)(4)(B). The Court grants plaintiff's application to proceed in forma pauperis 3 because it does not appear that he had afford the filing fee. The Court denies plaintiff's motion for attorney representation and a related motion 4 8 without prejudice to renewal. Plaintiff has not shown that he requires legal representation (at least not at this point) to prosecute his case. Plaintiff's motion for leave to file exhibits in support of his complaint 9 is granted. However plaintiff must file an amended complaint that includes both his complaint and the exhibits so that when summons and the complaint are served on the defendant the complaint contains everything. Plaintiff is given until 9/26/2022 to file an amended complaint that includes his exhibits. 2022-09-2613MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff John Bridenhagen has filed a very short request that is quite cryptic appears to be a request for appointment of counsel. The request is denied without prejudice because it does not include sufficient information. If plaintiff wishes to seek appointment of counsel he should use the forms on the US District Court website for appointment (recruitment) of counsel and should file at the same time an updated financial affidavit so that the Court can assess his current ability to retain counsel. Plaintiff is also reminded that the Court has previously ordered him to file by 9/26/2022 a complete version of his amended complaint that includes all exhibits. 2022-10-0218MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff has filed an amended complaint but, as before, has not included his supporting exhibits with the complaint but rather filed them separately. As the Court stated in its 9/12/2022 order, that's not the right way to do it. Specifically, as stated in the 9/12/2022 order, "plaintiff must file an amended complaint that includes both his complaint and the exhibits so that when summons and the complaint are served on the defendant the complaint contains everything." For this reason, plaintiff's motion for leave to file exhibits 14 is denied, and his amended complaint is stricken. His motion for attorney representation 16 is also denied without prejudice as premature because there's no basis at this point to believe that plaintiff needs an attorney in order to pursue his case. For now, in order for the case to proceed, plaintiff just needs to follow the Court's relatively simple instructions: file as a single document his amended complaint with all of the exhibits. The Court gives plaintiff until 10/7/2022 to do this. If plaintiff does not comply this time, the Court may dismiss his case due to noncompliance with court orders. (mk) (Entered: 10/02/2022)

2023-01-0738MINUTE entry before the Honorable Matthew F. Kennelly: This is a lawsuit under the Freedom of Information Act, filed by the plaintiff pro se. Plaintiff's motion for leave gto file inventory 35 and motion for leave to file affidavit 37 are both granted. The Court notes that plaintiff has filed three documents 31 33 34 that appear to assume that the defendant has filed a motion for summary judgment. That's incorrect; no such motion has been filed by the defendant. Rather, it has simply filed an answer to plaintiff's complaint 30 . The Court notes that defendant'a answer is prefaced with a statement that plaintiff's compliant is "largely incomprehensible." The Court agrees with this assessment. The Court is therefore assessing whether to dismiss the complaint is incomprehensible and/or as frivolous pursuant to 28 USC 1915(e)(2). In this regard, the Court directs the plaintiff to file by 1/23/2023 a statement (which the Court will consider as an amendment to the complaint) that includes the following information: (a) The dates of any FOIA requests that the plaintiff sent to the defendant Defense Intelligence Agency; (b) If available, copies of any such requests; (c) The dates of Defense Intelligence Agency's responses to any FOIA requests by the plaintiff; and (d) If available, copies of any such responses.
