2024-12-09MINUTE ORDER granting Defendants' 43 Motion for Extension of Time. Defendants move for a 30-day extension of the deadline for filing their motion for summary judgment in this second round of briefing. They explain that briefing is taking longer than expected because the case involves multiple intelligence agencies and "may involve information at elevated classification levels." Additionally, Defendants' counsel was assigned to this case after the first round of summary-judgment briefing and has thus devoted significant time to developing familiarity with the case. Plaintiff opposes any extension longer than one week because he claims that Defendants have already caused delays in this case. He also speculates that Defendants will not comply with a deadline of January 10, 2025, if they obtain a one-month extension. But that speculation is no basis for opposing this extension request. And as the Court explained in its oral ruling, both parties contributed to the problems with the initial round of briefing that have extended this case. Accordingly, for the reasons set forth in Defendants' 43 Motion, it is hereby ORDERED that Defendants' 43 Motion is GRANTED. It is further ORDERED that the briefing schedule set forth in the Court's October 30, 2024 Minute Order is hereby MODIFIED as follows: Defendants shall file their motion for summary judgment by January 10, 2025; Plaintiff shall file a combined cross-motion for summary judgment and opposition to Defendants' motion by February 24, 2025; Defendants shall file a combined brief in opposition to Plaintiff's cross-motion and in support of Defendants' motion for summary judgment by March 26, 2025; and Plaintiff shall file his reply in support of his cross-motion for summary judgment by April 28, 2025.
