2023-06-09MINUTE ORDER. Pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(i), "the plaintiff may dismiss an action without a court order by filing... a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment[.]" The Court deems plaintiff's 2 3 motion to dismiss to be a notice of dismissal. Therefore, the Clerk of Court is directed to terminate the case and the motion is DENIED as moot. Given that the Clerk's Office has already been involved with this case, docketing the complaint and other materials, plaintiff's request for the return of the filing fee is also DENIED in the Court's discretion.
