Case DescriptionAmericans for Prosperity Foundation submitted two FOIA requests to the National Institute of Standards and Technology. AFPF's first request asked for communications concerning the spending of CHIPS funds and a list of keywords. AFPF also asked for a fee waiver. The agency acknowledged receipt of the request. AFPF's second request asked for records concerning communications that included CHIPS and a list of keywords. AFPF also requested a fee waiver. The agency acknowledged receipt of the request but after hearing nothing further from the agency concerning either request, AFPF filed suit.
