2024-12-12 | | MINUTE ORDER: The docket reflects that no proof of service has been filed as required by the Federal Rules of Civil Procedure and this Courts Local Civil Rules. See Fed. R. Civ. P. 4(l)(1); LCvR 5.3. Plaintiffs are advised that service must be accomplished consistent with Federal Rule of Civil Procedure 4. Plaintiffs are further advised that, under Federal Rule of Civil Procedure 4(m), they were required to serve Defendant within 90 days of filing their complaint or show good cause for an extension. That deadline, April 15, 2024, has long passed. Indeed, Plaintiffs not only missed that deadline but have failed to take any other action reflected on the docket to prosecute the case since filing it. Thus, it is hereby ORDERED that, to avoid dismissal of this action, Plaintiffs shall, by December 27, 2024, either (1) cause process to be served on Defendant and file proof of service with the Court pursuant to Federal Rule of Civil Procedure 4(l)(1), or (2) move to enlarge time to serve process and show good cause for failing to serve process timely. Failure to do so may result in dismissal of the case for failure to serve Defendant or for failure to prosecute the case. Signed by Judge Timothy J. Kelly on 12/12/2024.
