MEMORANDUM OPINION AND ORDER signed by the Honorable Matthew F. Kennelly on 11/3/2025: For the reasons stated in the accompanying Memorandum Opinion and Order, the Court denies the Army's motion for summary judgment [dkt. 10]. The Court grants Stevens's cross motion for summary judgment [dkt. 14] regarding the lakefront expansion request but denies it regarding the helicopter request. The Army is directed to conduct and complete, by no later than January 6, 2026, a search for records responsive to the lakefront expansion request. The Army is further directed to supplement, by no later than December 5, 2025, its affidavits regarding the helicopter request to provide additional detail regarding which specific electronic databases were searched, why they were chosen, and how those searches were conducted. The Court acknowledges that the current shutdown status of the government may require extension of these deadlines, depending on how long it lasts. In the interim, a telephonic status hearing is set for November 18, 2026 at 8:55 a.m., using call-in number 650-479-3207, access code 2305-915-8729. The Court will reset that hearing as well if the government is still shut down as of that date. (mk) (Entered: 11/03/2025) |

ORDER denying as moot 9 Motion for Extension of Time to Answer or Otherwise Respond. This matter is before the court on Defendant's Unopposed Motion for Extension of Time Due to Lapse in Congressional Appropriations (ECF No. 9). The motion for extension is premised on an October 27, 2025 response deadline, but under Fed. R. Civ. P. 12(a)(2) the United States' deadline to answer or otherwise respond is December 1, 2025. Because the motion seeks to extend an incorrect deadline, it is denied as moot. Defendant shall answer or otherwise respond to the Complaint on or before December 1, 2025.
