MINUTE ORDER: Upon consideration of the Motion to Transfer Case 21 , and the Motion for Reconsideration on Order on Motion for Leave to Appeal in forma pauperis, Dkt. 21 , it is hereby ORDERED that the motion is DENIED. Plaintiff has not demonstrated that he qualifies to appeal in forma pauperis. To start, it is not clear whether the order Plaintiff seeks to appeal is, in fact, appealable. Under some circumstances denials of motions to proceed in forma pauperis are immediately appealable: for example, when the denial effectively blocks a litigant's access to the courts. See Ficken v. Alvares, 146 F.3d 978, 982 (D.C. Cir. 1998). Plaintiff's motion, however, was denied without prejudice not on the merits but because he failed to fill out the required forms. See Dkt. 7. The court, in denying his motion, gave him permission to "submit a completed IFP motion along with a motion to reconsider th[e] order" within 30 days. Id. Accordingly, it is questionable whether that denial blocked Plaintiff's access to the Courts such that it would be immediately appealable. In any event, Plaintiff has not shown that he satisfies the financial requirement for obtaining leave to appeal in forma pauperis. Unlike at the district court stage of the litigation, Plaintiff has (albeit belatedly) filed the forms required to apply to appeal in forma pauperis. On those forms, Plaintiff avers that he has no income from wages, but that in 2024 he received $71,290 of income in the form of Roth IRA distributions. See Dkt. 20 at 1, 4. Plaintiff has thus failed to meet his burden of demonstrating an "inability to pay or to give security for fees and costs." Fed. R. App. P. 24(a)(1)(A). Plaintiff has also failed to demonstrate that transfer of this case is warranted. Plaintiff chose to file suit in this Court, and he cannot now ask that the case be transferred because he is dissatisfied with this Court's rulings. Signed by Judge Randolph D. Moss on 5/2/25.
