MINUTE ORDER (paperless), DENYING plaintiff's 55 Motion to Compel Production and for Contempt Sanctions ("Pl.'s Mot."), and DENYING intervenor Bola Tinubu's 56 Motion to Confirm Applicability of FOIA Exemptions ("Intervenor's Mot."). Neither motion has merit and both appear to be predicated on a misapprehension of the prior decision issued in this matter, which decision concluded, in pertinent part, that neither the Drug Enforcement Administration ("DEA") nor the Federal Bureau of Investigation ("FBI") appropriately invoked Glomar responses when declining to confirm or deny the existence of investigative files about intervenor Bola Tinubu or his alleged associate Abiodun Agbele. Greenspan v. Exec. Off. For U.S. Att'ys , No. 23-cv-1816 (BAH), 2025 WL 1040834, *9, 12 (D.D.C. Apr. 8, 2025) (emphasis supplied). Plaintiff now seeks to compel these two agencies to produce responsive records and information that may otherwise be exempt, under 5 U.S.C. § 552(b)(6) or (b)(7)(C) (exempting from disclosure personnel, medical and similar records when disclosure "would constitute a clearly unwarranted invasion of personal privacy," and law enforcement records for a variety of enumerated reasons). See Pl.'s Mot. at 3-4. Conversely, Tinubu seeks confirmation that the agencies' responses to plaintiff's FOIA requests "can and should withhold or redact records that identify [Tinubu]." Intervenor's Mot. at 1. Application of FOIA Exemptions 6 and 7(C) to records responsive to plaintiff's FOIA requests was not an issue resolved in the prior decision, which was limited to the appropriateness of the agencies' blanket Glomar responses, Greenspan , 2025 WL 1040834, at *6, 9 (ruling on Glomar responses only), and thus did not address the application of any FOIA exemptions, id. at *13 (directing FBI and DEA to search for and process non-exempt records (emphasis supplied)). Both plaintiff and Intervenor Tinubu seek a ruling that is premature at this juncture, since any evaluation of the applicability of Exemptions 6 and 7(C) to specific records would be appropriate only when production is complete and the agency's justification for any challenged withholding is before the Court. Therefore, plaintiff's and intervenor's separate motions for such a premature ruling on the applicability of Exemptions 6 and 7(C) to any responsive records are DENIED. Additionally, plaintiff seeks a court order compelling immediate, 48-hour turnaround production by the FBI and DEA of responsive records without redactions of information withheld as exempt. See Pl.s Mot. at 6. DEA has completed its productions, with the exception of 12 pages subject to review by other agencies, 58 Joint Status Report ¶ 3 (Sept. 17, 2025), and the FBI has completed its search for responsive records and anticipates beginning productions on December 1, 2025, id. ¶ 2. Insofar as plaintiff seeks to compel both DEA and the FBI to produce immediately any records (or portions of records) withheld as exempt, such request is premature for the same reasons already explained above and therefore DENIED. As to records not yet produced, plaintiff's demand for immediate production amounts to "jump[ing] the line to have his requests addressed before others in any queue pending before" defendants. See 32 Memorandum and Order (Nov. 21, 2023) (denying plaintiff's 17 Emergency Motion to Compel Immediate Production and subsequent 22 Motion for Reconsideration). Plaintiff has not shown, or even attempted to show, that he is entitled to the injunctive relief so demanded. Id. (citing Winter v. Natural Res. Def. Council, Inc. , 555 U.S. 7, 20 (2008) (standard for a preliminary injunction)); see also Weinberger v. Romero-Barcelo , 456 U.S. 305, 311-13 (1982) (standard for injunctive relief). Moreover, the parties have already been directed to file, by December 1, 2025, a joint status report on the status of processing, including the FBI's planned first production on that date, see Minute Order (Sept. 19, 2025); Joint Status Report ¶ 2 (Sept. 17, 2025), though, due to the federal government's current lapse in appropriations, these dates will be adjusted, pursuant to Standing Order No. 25-55 (JEB), available at https://www.dcd.uscourts.gov/sites/dcd/files/Executive% 20Order%2025-55.pdf . Accordingly, plaintiff's motion to compel immediate production of responsive records is DENIED. Finally, given the foregoing conclusions, plaintiff's motion for sanctions to be imposed, allegedly because the "FBI and DEA are actively engaged in a deliberate effort to defy this Court's Order," Pl.'s Mot. at 1, is DENIED, as nothing in the agencies' ongoing processing of responsive records appears to violate any court order.
